The
Labour Court has dismissed the case of Ntoyakhe Mgcineni, a former official of
the Umsobomvu Local Municipality, who claimed he was unfairly dismissed after
being elected as a councillor in 2021. The South African Municipal Workers’
Union (Samwu) sought to overturn Mgcineni's dismissal, but the court rejected
their appeal on June 20, 2024. Mgcineni, who was the head of community
development, was deemed to have resigned upon his election. He had joined the
Umsobomvu Residents Association (URA) and was second on their candidate list
for the local elections. After the URA won two council seats, he requested to
withdraw his candidacy shortly thereafter.
